Based on Articles 15, 16 and others applicable of the Federal Law on the Protection of Personal Data in Possession of Individuals (the “Law”) and its regulations we make known that Greenatopia S.A de C.V hereinafter (“Greenatopia Real Estate”) with address at Playacar Fase 2, Zip Zode 77717 Playa del Carmen, Quintana .Roo .same that is intended to hear and receive notifications, is responsible for the use and protection of personal data, and in this regard informs you the following:
I. MAINPURPOSES
The personal data we will collect from you will be used for the following purposes, which are necessary to carry out and maintain the legal relationship between the controller and the owner, in order to provide you with the service you request: advise in real estate investment service, for the creation, updating, and preservation of an identification dossier, to maintain communication in order to provide a better service and compliance with federal and local laws.
II. SECONDARY PURPOSES
In addition, we will use your personal information for the following purpose that which allow us and facilitate to provide you with better care:
• For marketing, advertising or commercial prospecting purposes;
• Notify you about new services or products that relate to those already contracted, with which it is considered to be of interest or communicate changes to them;
• Carry out regular evaluations of our products and services in order to improve the quality of them.
In case you do not want your personal data to be processed for these additional purposes, you can express your refusal through the right of Opposition through the mechanism described in section VI.
The refusal to use your personal data for these secondary purposes may not be a reason for us to deny you the services and products you request or contract with us.
III. PERSONAL DATA PURPOSE TO BE PROCESSED
To carry out the purposes described in this privacy notice, we will use the following personal data:
• Identification data: name, place and date of birth, nationality, Federal Taxpayer Registration, Unique Population Registration Key (CURP), current identification number, occupation marital status, main investment purposes and personal finance information if it’s needed.
• Contact details: address, landline phone, mobile phone, email.
Likewise, at the time of entering our facilities your image will be recorded, the above for the purpose of protection, security and crime prevention, which will have a storage duration of 60 days, after the previous period, your images will be deleted from our servers / cloud.
Note: In order to carry out the purposes of this privacy notice, it is not necessary to obtain sensitive personal data.
IV. DATA TRANSFERS
Your personal data may be transferred and processed in and out of the country with persons or entities other than Greenatopia Real Estate, for the following purposes:
For the creation, updating, and preservation of an identification record and compliance with federal and local laws.

We undertake not to transfer your personal data to third parties without your consent, except for the exceptions provided for in article 37 of the Law, as well as to make this transfer under the terms set out in such legal order.
V. MEANS FOR OBTAINING PERSONAL DATA
For the purposes indicated in this privacy notice we may collect your personal data in different ways: landing pages, big data extracted by artificial intelligence, directly in offices and points of sale, via website, and other public sources permitted by the Law.
VI. MEANS AND PROCEDURE TO EXERCISE ARCO RIGHTS
We want to let you know that at any time you have the right to Access, Rectification, Cancellation or Opposition over the processing of your personal data (ARCO rights). You may exercise your ARCO rights, as well as withdraw the consent you have given us for the processing of your personal data.
However, it is important to note that not in all cases we will be able to fulfill your request or terminate the use immediately, as it is possible that by some legal obligation we require to continue processing your personal data.
In order for you to exercise your ARCO rights and/or withdraw your consent to the processing of your personal data you can do so by free letter signed by your owner or representative with powers sent by email to the following address: contact@greenatopiarealestate.com The application must contain and include the following:
1. Personal data owner´s name.
2. Phone number and email.
3. Clear and accurate description of personal data in respect of which it seeks to exercise any of afore mentioned rights. Any other element or document that facilitates the location of personal data.
4. Applicant´s identification or document with necessary powers to be able to exercise such rights on behalf of a third party.
5. In case of requests for rectification of personal data, the owner shall indicate the modifications to be made in addition to provisions of subparagraphs 1,2,3 and 4.
Upon receipt, Greenatopia Real Estate will have a period of 20 business days to respond to your request, however, this period may be extended for an equal period of time, which will be notified to you, by the means you have indicated to us for such purposes, indicating the reasons for such extension, under Article 32 of the Federal Law on the Protection of Personal Data in Possession of Individuals.
In the event that the information provided in the application is insufficient or erroneous to meet it, or is not accompanied by the documents referred to, or does not clearly indicate the modifications to be made, the controller may require the owner, for once and within five days of receipt of the request to provide the elements or documents necessary to process your application. The owner will have ten days to comply with the requirement, counted from the time you receive the request. If no response is made within that period, the relevant application will be considered as unsubmitted.
VII. LIMITATION ON THE USE OR DISCLOSURE OF PERSONAL DATA
In addition to the exercise of ARCO rights and the revocation of consent, it is possible to limit the use and disclosure of personal information through following mechanisms:
Registration in the Public Registry to Avoid Advertising (REPEP), which is carried out by the Federal Consumer Protection Agency (PROFECO*), or in the Public Registry of Users (REUS*) of the National Commission for the Protection and Defense of Financial Services Users (CONDUSEF*). (*all as in Spanish).
